These Terms of Service ("Terms") govern your access to and use of MedSage (the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
2. Not medical advice
The Service does not provide medical advice, diagnosis, or treatment. The AI-generated content is informational and educational only. It is not a substitute for professional medical advice, examination, or treatment. Always consult a qualified healthcare professional with any questions you may have regarding a medical condition. Never disregard or delay seeking professional medical advice because of information you obtained from the Service.
In a medical emergency, call your local emergency services immediately. The Service is not designed for emergency situations and may be unavailable at any time.
3. Your account
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use. You agree to provide accurate information and to keep it up to date. We may suspend or terminate accounts that violate these Terms.
4. Acceptable use
You agree not to:
- Use the Service to make decisions in life-threatening situations without consulting a medical professional.
- Submit content on behalf of another person without that person's consent.
- Upload images that are unlawful, sexually explicit, or that depict identifiable third parties without consent.
- Reverse engineer, decompile, or attempt to extract the source code or model weights of the Service.
- Use automated means (scrapers, bots) to access the Service except via published APIs and within reasonable limits.
- Interfere with or disrupt the Service, including by introducing malware or attempting unauthorized access.
- Use the Service to provide professional medical services to third parties without your own appropriate licensure.
5. Intellectual property
The Service, including its design, code, content, and trademarks, is owned by MedSage or its licensors and protected by intellectual property laws. You receive a limited, non-exclusive, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
You retain ownership of the content you submit. By submitting content, you grant us a worldwide, royalty-free license to use that content solely to operate, secure, and improve the Service (including transmitting it to AI processors as described in the Privacy Policy).
6. Third-party services
The Service relies on third-party AI providers. Your use of these underlying services is also subject to the respective providers' terms. We are not responsible for the actions or omissions of third-party providers.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI-GENERATED CONTENT IS ACCURATE, COMPLETE, OR CURRENT.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MEDSAGE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD 100).
9. Indemnification
You agree to indemnify and hold harmless MedSage and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including breach of these Terms. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination will do so (including disclaimers, limitations of liability, and indemnities).
11. Changes to these Terms
We may update these Terms periodically. Material changes will be announced on this page with a revised "Last updated" date. Continued use of the Service after a change constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which MedSage is operated, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Service will be resolved exclusively in the competent courts of that jurisdiction, except where applicable consumer protection law gives you a right to bring proceedings in your local courts.
13. Contact
Questions about these Terms can be sent through the Contact page.
